NGT continued the stay on EC and Land acquisition except allowing directly purchasing land for coal mining and coal washery by Jindel Steel Power limited.

The appeal was filed against the Environment Clearance (EC) order given to M/S Jindal Steel Power Ltd granted by Ministry of Environment and Forests. The NEAA by order dated 12.05.2010 directed the project proponent to maintain status quo in the field activities. The Project Proponent filed application for recall of the stay order. The appellant claimed that as they have a prima facie case‚ the Tribunal should not grant any interim relief in favour of Jindal Steel Power Ltd as that would cause damage to the environment at the site.

The tribunal allowed Jindal Steel Power Ltd to acquire/purchase private lands by negotiations from the landowners at their own risk. Jindal was also allowed to carry on plantation and other environment friendly activities but they shall not make any construction or development or extract coal or any other activities related to land acquisition.
